Depuis bien longtemps d\u00e9j\u00e0, la D\u00e9fense nationale n\u2019est pas un mod\u00e8le \u00e0 suivre quand il s\u2019agit de respecter la Loi sur l\u2019acc\u00e8s \u00e0 l\u2019information. Son manque de transparence s\u2019av\u00e8re particuli\u00e8rement pr\u00e9occupant depuis que les porte-parole du minist\u00e8re de la D\u00e9fense nationale (MDN) ont publi\u00e9 une d\u00e9claration controvers\u00e9e sur la guerre \u00e0 Gaza et ont ensuite fait fi de la loi en refusant de r\u00e9pondre \u00e0 la demande d\u2019acc\u00e8s \u00e0 l\u2019information d\u2019un journaliste qui souhaitait savoir comment le MDN en \u00e9tait venu \u00e0 ces conclusions.<\/p>\n

Le plus r\u00e9cent exemple : le journaliste du Globe and Mail Frederik-Xavier D. Plante a demand\u00e9 l\u2019acc\u00e8s \u00e0 des documents militaires internes faisant le bilan sur le bombardement d\u2019un h\u00f4pital de Gaza. Le minist\u00e8re n\u2019a pas r\u00e9pondu dans le d\u00e9lai prescrit de 30 jours, n\u2019a pas demand\u00e9 de prolongation, et a m\u00eame rejet\u00e9 une ordonnance<\/a> de produire des documents de la Commissaire \u00e0 l\u2019information Caroline Maynard, soutenant qu\u2019il irait devant les tribunaux pour faire annuler cette ordonnance.<\/p>\n

Avec tous ses secrets militaires et proc\u00e9dures de s\u00e9curit\u00e9 \u00e0 prot\u00e9ger, la D\u00e9fense nationale n\u2019est pas une sin\u00e9cure \u00e0 g\u00e9rer.<\/p>\n

Cela dit, la situation entourant la demande li\u00e9e \u00e0 Gaza a touch\u00e9 un nerf sensible. Dans sa d\u00e9claration, le minist\u00e8re en venait \u00e0 la conclusion que les Forces de d\u00e9fense isra\u00e9liennes n\u2019\u00e9taient pas responsables de l\u2019attaque qui a fait au moins 100 morts dans un h\u00f4pital de Gaza. Tant les FDI que le Hamas ont ni\u00e9 toute responsabilit\u00e9. M. Plante voulait savoir sur quoi se fondait la d\u00e9claration du MDN<\/a>.<\/p>\n

L\u2019obstination du minist\u00e8re est certes frustrante, mais elle n\u2019a rien de surprenant. Dans son plus r\u00e9cent rapport annuel<\/a>, Mme Maynard \u00e9crit avoir rendu 32 ordonnances contre la D\u00e9fense nationale.<\/p>\n

Mme Maynard a comparu devant la Cour f\u00e9d\u00e9rale \u00e0 trois reprises pour demander un bref de mandamus, c\u2019est-\u00e0-dire une demande pr\u00e9sent\u00e9e au tribunal pour que celui-ci ordonne au minist\u00e8re de se conformer \u00e0 l\u2019ordonnance de la Commissaire. N\u2019oublions pas que toutes ces escarmouches juridiques inutiles sont financ\u00e9es par des fonds publics.<\/p>\n

L\u2019un des probl\u00e8mes est le fait que la D\u00e9fense nationale assure une rotation relativement rapide des membres de son unit\u00e9 d\u2019acc\u00e8s \u00e0 l\u2019information; il y a donc peu d\u2019occasions pour ceux-ci d\u2019acqu\u00e9rir des comp\u00e9tences en la mati\u00e8re. En outre, la structure hi\u00e9rarchique stricte des forces arm\u00e9es favorise une culture de d\u00e9f\u00e9rence, ce qui signifie que le personnel de l\u2019AIPRP (Acc\u00e8s \u00e0 l\u2019information et protection des renseignements personnels) n\u2019est souvent pas \u00e0 l\u2019aise d\u2019exprimer son d\u00e9saccord (m\u00eame s\u2019il est justifi\u00e9) lorsqu\u2019un officier sup\u00e9rieur rechigne \u00e0 l\u2019id\u00e9e de communiquer des documents.<\/p>\n

R\u00e9sultat : les journalistes sont laiss\u00e9s en plan et ne sont pas en mesure d\u2019informer le public sur l\u2019une des institutions f\u00e9d\u00e9rales canadiennes qui a le plus d\u2019influence et dont les d\u00e9penses sont les plus importantes. C\u2019est pourquoi nous ne savons rien de l\u2019analyse de la D\u00e9fense nationale sur l\u2019incident \u00e0 Gaza. Et c\u2019est pourquoi le minist\u00e8re est si souvent libre d\u2019agir sans se soucier d\u2019\u00eatre surveill\u00e9 ou de devoir rendre des comptes.<\/p>\n
