Radio-Canada (CBC) s\u2019\u00e9tait vu refuser l\u2019acc\u00e8s \u00e0 ces lettres en\u00a02018 \u00e0 la suite d\u2019une demande en vertu de la loi provinciale sur l\u2019acc\u00e8s \u00e0 l\u2019information.<\/p>\n<p>Au terme de nombreuses d\u00e9cisions et de nombreux appels, la Cour supr\u00eame a tranch\u00e9 la question. Le secret l\u2019a emport\u00e9 haut la main.<\/p>\n<p>Cette d\u00e9cision de grande port\u00e9e pourrait entra\u00eener la retenue abusive de documents li\u00e9s au cabinet dans des affaires ult\u00e9rieures.<\/p>\n<p>En juin\u00a02019, la commissaire \u00e0 l\u2019information du Canada a obtenu le pouvoir de rendre des ordonnances. Ainsi, les minist\u00e8res qui contreviennent aux lois sur l\u2019acc\u00e8s \u00e0 l\u2019information pourraient maintenant recevoir l\u2019ordre de communiquer des documents.<\/p>\n<p>Ces ordonnances ne sont toutefois pas contraignantes, malgr\u00e9 ce que le gouvernement peut pr\u00e9tendre. Certains minist\u00e8res les ignorent tout simplement.<\/p>\n<p>La commissaire \u00e0 l\u2019information est all\u00e9e en cour <a href=\"https:\/\/www.oic-ci.gc.ca\/fr\/resume-du-mandat-au-25-octobre-2024\">au moins six fois<\/a> afin de demander \u00e0 un juge f\u00e9d\u00e9ral de rendre une ordonnance judiciaire pour contraindre les minist\u00e8res r\u00e9calcitrants \u00e0 donner suite \u00e0 ses ordonnances. Le minist\u00e8re de la D\u00e9fense nationale a \u00e9t\u00e9 le pire contrevenant jusqu\u2019\u00e0 pr\u00e9sent, et la situation a empir\u00e9 en\u00a02024.<\/p>\n<p>Ces affaires accaparent des ressources juridiques substantielles de part et d\u2019autre, et les fonds publics seraient mieux d\u00e9pens\u00e9s s\u2019ils \u00e9taient consacr\u00e9s \u00e0 l\u2019am\u00e9lioration du syst\u00e8me d\u2019acc\u00e8s \u00e0 l\u2019information.<\/p>\n<p>Les documents gouvernementaux ont eu la f\u00e2cheuse habitude de dispara\u00eetre en\u00a02024&#8230;<\/p>\n<p>L\u2019Agence des services frontaliers du Canada <a href=\"https:\/\/www.secretcanada.com\/news\/cbsa-lost-foi-requests\">a r\u00e9ussi \u00e0 perdre 12\u00a0000\u00a0demandes d\u2019acc\u00e8s \u00e0 l\u2019information<\/a>, imputant ce fiasco \u00e0 des probl\u00e8mes techniques.<\/p>\n<p>\u00c0 l\u2019automne, le gouvernement de l\u2019Alberta <a href=\"https:\/\/thenarwhal.ca\/alberta-foip-bill-34\/\">a pr\u00e9sent\u00e9 un projet de loi<\/a> visant \u00e0 prot\u00e9ger davantage l\u2019information contre la divulgation, y compris les renseignements factuels li\u00e9s \u00e0 ses d\u00e9cisions. La commissaire \u00e0 l\u2019information de la province a d\u00e9crit la situation comme une \u00ab\u00a0\u00e9rosion des droits d\u2019acc\u00e8s\u00a0\u00bb.<\/p>\n<p>Lors des \u00e9lections de cette ann\u00e9e en Nouvelle-\u00c9cosse, le premier ministre, Tim\u00a0Houston,<a href=\"https:\/\/www.cbc.ca\/news\/canada\/nova-scotia\/order-making-power-nova-scotia-information-commissioner-1.7373810\"> a refus\u00e9 de s\u2019engager <\/a>\u00e0 donner \u00e0 la commissaire \u00e0 l\u2019information de la province le pouvoir de rendre des ordonnances, revenant ainsi sur l\u2019une des promesses qu\u2019il avait faites lors de l\u2019\u00e9lection de\u00a02021, lorsqu\u2019il a remport\u00e9 sa premi\u00e8re victoire comme chef du gouvernement. Au niveau f\u00e9d\u00e9ral, la Loi sur l\u2019acc\u00e8s \u00e0 l\u2019information<a href=\"https:\/\/www.theglobeandmail.com\/canada\/article-ottawa-has-declined-to-overhaul-its-access-to-information-system-for\/\"> n\u2019est plus \u00e0 l\u2019ordre du jour politique<\/a>, malgr\u00e9 les promesses de r\u00e9forme l\u00e9gislative du gouvernement.<\/p>\n<p>Dans un souci de transparence, un groupe non gouvernemental a lanc\u00e9 l\u2019an dernier le projet <a href=\"https:\/\/theijf.org\/open-by-default\">Open By Default<\/a>, qui publie sur le\u00a0Web l\u2019information qu\u2019Ottawa refuse de rendre accessible au public. \u00c0 ce jour, 48\u00a0000\u00a0documents ont \u00e9t\u00e9 publi\u00e9s dans le cadre de ce projet, et ce nombre continue de cro\u00eetre chaque semaine.<\/p>\n<p>L\u2019ann\u00e9e\u00a02025 nous r\u00e9serve des \u00e9lections f\u00e9d\u00e9rales et un changement de gouvernement.
