Smith, a \u00e9t\u00e9 d\u00e9sign\u00e9 laur\u00e9at provincial du <a href=\"https:\/\/caj.ca\/a-blanket-smother-up-alberta-government-wins-secrecy-award-for-opaque-access-to-information-process\/\">Prix du Code du silence 2025<\/a> pour l\u2019excellence en mati\u00e8re de secret gouvernemental par un regroupement de trois organisations journalistiques, apr\u00e8s que la commissaire \u00e0 l\u2019information et \u00e0 la protection de la vie priv\u00e9e de l\u2019Alberta eut conclu que <a href=\"https:\/\/www.theglobeandmail.com\/canada\/article-alberta-government-violated-freedom-of-information-laws-information\/\">la province avait enfreint sa propre l\u00e9gislation sur l\u2019acc\u00e8s \u00e0 l\u2019information.<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">L\u2019enqu\u00eate de la commissaire, qui portait sur 27 organismes publics, a \u00e9t\u00e9 d\u00e9clench\u00e9e \u00e0 la suite de demandes de r\u00e9vision concernant des demandes d\u2019acc\u00e8s \u00e0 l\u2019information que le gouvernement avait refus\u00e9 de traiter, dont plusieurs pr\u00e9sent\u00e9es par <em>The Globe and Mail<\/em> dans le cadre de son projet <a href=\"https:\/\/www.theglobeandmail.com\/topics\/secret-canada\/\">Secret Canada<\/a> sur l\u2019acc\u00e8s \u00e0 l\u2019information.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Dans un rapport publi\u00e9 en <a href=\"https:\/\/oipc.ab.ca\/wp-content\/uploads\/2025\/05\/F2025-IR-01.pdf\">mai 2025<\/a>, la commissaire \u00e0 l\u2019information et \u00e0 la protection de la vie priv\u00e9e, Diane McLeod, a conclu que le gouvernement de l\u2019Alberta exigeait ill\u00e9galement que les demandeurs limitent leurs demandes d\u2019acc\u00e8s \u00e0 un seul sujet, scindent les demandes portant sur plusieurs sujets, restreignent la p\u00e9riode vis\u00e9e par la recherche de documents \u00e0 12 mois et formulent leurs demandes de fa\u00e7on \u00e0 ce qu\u2019elles puissent \u00eatre trait\u00e9es dans un d\u00e9lai de 30 jours.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La commissaire a formul\u00e9 plusieurs recommandations, notamment que le gouvernement provincial mette fin \u00e0 ces pratiques non conformes et qu\u2019il adopte des politiques et des proc\u00e9dures afin de s\u2019assurer que les organismes publics respectent leurs obligations en vertu des lois sur l\u2019acc\u00e8s \u00e0 l\u2019information.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Mme McLeod a indiqu\u00e9 \u00e0 l\u2019\u00e9poque que, m\u00eame si le gouvernement de l\u2019Alberta pr\u00e9voyait remplacer sa <em>Freedom of Information and Protection of Privacy Act<\/em> (FOIP), ses recommandations continueraient de s\u2019appliquer aux dispositions de la nouvelle l\u00e9gislation qui seraient \u00ab identiques ou essentiellement similaires \u00bb.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">L\u2019Alberta a depuis remplac\u00e9 la <a href=\"https:\/\/edmontonjournal.com\/news\/politics\/albertas-new-access-information-rules-in-effect\"><em>FOIP Act<\/em><\/a> par deux nouvelles lois : <a href=\"https:\/\/open.alberta.ca\/publications\/a01p4\">l\u2019<em>Access to Information Act<\/em><\/a> et la <a href=\"https:\/\/open.alberta.ca\/publications\/p28p5\"><em>Protection of Privacy Act<\/em><\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Selon plusieurs critiques, l\u2019<em>Access to Information Act<\/em> <a href=\"https:\/\/edmontonjournal.com\/news\/politics\/albertas-new-access-information-rules-in-effect\">restreint davantage les renseignements<\/a> que le gouvernement provincial peut divulguer et rend le processus d\u2019acc\u00e8s \u00e0 l\u2019information plus complexe et moins transparent.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Parmi les dispositions les plus contest\u00e9es, la loi soustrait \u00e0 la divulgation les documents faisant \u00e9tat de communications entre les membres du personnel politique, ainsi qu\u2019entre les ministres et leur personnel politique.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Les Prix du Code du silence sont d\u00e9cern\u00e9s chaque ann\u00e9e par l\u2019Association canadienne des journalistes (<a href=\"https:\/\/caj.ca\/\">CAJ<\/a>), le Centre for Free Expression (<a href=\"https:\/\/cfe.torontomu.ca\/\">CFE<\/a>) de l\u2019Universit\u00e9 m\u00e9tropolitaine de Toronto et Canadian Journalists for Free Expression (<a href=\"https:\/\/cjfe.org\/\">CJFE<\/a>).
